Rights to privacy

Green Energy Exchange Pty Limited trading as ACXargyle (“ACX, we or our”) understands the importance of protecting individuals’ rights to privacy. We have prepared this statement to help you understand how we aim to protect the privacy of our customers’ personal information and the personal information of others that a customer may enter on to or access from our web-site.

In handling personal information, ACX is subject to the Privacy Act 1988 and complies with the ten National Privacy Principles in the Act.

This policy describes the way ACX collects, uses and discloses personal information and a customer’s rights in relation to our management of personal information. This policy may be updated from time to time.

What kinds of personal information does ACX collect?

The kinds of personal information we collect from our customers are:

  • name and contact details including contact address and e-mail address 

  • information regarding the size of the donation or purchase or nominal energy usage. 

How does ACX collect personal information?

Generally, ACX collects personal information directly from each customer. There may be occasions when ACX collects personal information from other sources such as from publicly maintained record. In the event that ACX collects information about a customer from a third party, we will take reasonable steps to inform that customer from whom, how and why the information was collected.

Why does ACX need personal information?

We collect this information for the purposes of:

  • Creating a customer file to enable the customer to use the service 

  • Providing reminder notices and support 

  • Any purposes required by law. 

A failure by a customer to provide personal information may affect our ability to provide our service to that customer effectively.

 

Who do we disclose your personal information to?

To fully assist a customer, we may disclose personal information to a third party such as the national GreenPower program. Such disclosure is always on a confidential basis.

 

Security of personal information

ACX takes all reasonable steps to ensure that the personal information that it holds is protected against misuse, loss, unauthorised access, modification or disclosure.

We have taken measures to ensure that information that is entered in to by a customer is stored there securely.  Only authorized personnel will have access to that information.

Can you access the personal information ACX holds about you?

Each customer has the right to access the customer’s own personal information that we collect and hold. If at any time a customer would like to access or change its details, or would like more information on our approach to privacy, they can contact us.

Privacy Complaints

Please direct all privacy complaints to our Privacy Compliance Officer. A privacy complaint relates to any concern or dispute that you have with our privacy practices as it relates to your personal information. This could include matters such as how your personal information is collected, stored, used or disclosed, and how access to your personal information is provided.

At all times, privacy complaints will be treated seriously, dealt with promptly, and in a confidential manner.

Dealing with privacy complaints will not affect existing obligations or the commercial arrangements that exist between ACX and you.

The Privacy Compliance Officer will commence an investigation into your complaint. You will be informed of the outcome of your complaint following the completion of the investigation.

If you are unsatisfied with the outcome of your complaint, you may refer the complaint to the Federal office of the Privacy Commissioner.
